Welcome to ProprHome. By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms apply to all visitors, users, and others who access or use the service, including real estate agents, agencies, buyers, tenants, and property owners.
2. Service Description
ProprHome is a real estate platform that connects property buyers, tenants, agents, and agencies in Portugal. Our services include:
- Property listing and search functionality
- AI-powered property matching
- Communication tools between parties
- Analytics and market insights
- Document management and verification
ProprHome acts as an intermediary platform and does not directly participate in property transactions between users.
3. User Accounts
Account Creation
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
Professional Accounts
Real estate agents and agencies must provide valid professional credentials. We reserve the right to verify these credentials and suspend accounts that cannot be verified.
4. User Content
You retain ownership of content you submit to ProprHome, including property listings, photos, and descriptions. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on our platform.
You represent and warrant that:
- You own or have rights to the content you submit
- Your content is accurate and not misleading
- Your content does not violate any laws or third-party rights
- Property listings reflect actual available properties
5. Prohibited Activities
You agree not to:
- Post false, inaccurate, or misleading property information
- Engage in fraudulent activities or scams
- Harass, abuse, or harm other users
- Scrape or collect data from our platform without permission
- Attempt to gain unauthorized access to our systems
- Interfere with the proper functioning of the platform
- Use the service for any illegal purpose
- Impersonate another person or entity
- Violate any applicable laws or regulations
6. Payments & Fees
Pioneer Program
The Pioneer Program offers lifetime access for a one-time payment of EUR99. This payment is non-refundable except as required by applicable law.
Payment Processing
All payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service and authorize us to charge your payment method.
Refund Policy
Refund requests will be considered on a case-by-case basis within 14 days of purchase. Contact support@proprhome.com for refund inquiries.
7. Intellectual Property
The ProprHome platform, including its design, features, and content (excluding user-submitted content), is owned by ProprHome and protected by intellectual property laws.
You may not:
- Copy, modify, or distribute our platform or its content
- Use our trademarks without prior written consent
- Reverse engineer or attempt to extract source code
- Create derivative works based on our platform
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not warrant that:
- The service will be uninterrupted or error-free
- Property information is accurate or complete
- Results obtained from using the service will be accurate
- Any transaction between users will be successful
ProprHome does not verify property ownership, condition, or legal status. Users are responsible for conducting their own due diligence.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPRHOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid to us in the twelve months preceding the claim.
10. Termination
We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these Terms.
Upon termination:
- Your right to use the service will immediately cease
- Your listings will be removed from the platform
- We may delete your account data (subject to legal retention requirements)
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles.
Any disputes arising from these Terms or your use of the service shall be resolved in the courts of Lisbon, Portugal.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date.
Your continued use of the service after changes become effective constitutes acceptance of the revised Terms.
